Terms of Use

These Terms of Use ("Terms") govern your use of the Calmendar iPhone app (the "App"), operated by the Calmendar team ("we", "us"). By installing or using the App, you agree to these Terms.

1. License

We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on Apple devices you own or control, for personal, non-commercial purposes, in accordance with these Terms and the Apple App Store Terms.

2. Your content

You own the notes, tasks, reminders, recordings, and other content you create in the App ("Your Content"). The App stores Your Content primarily on your device. You are responsible for Your Content and for keeping your device and any backups secure.

3. Acceptable use

Do not use the App to violate any law or the rights of others.
Do not attempt to reverse engineer, decompile, or interfere with the App.
Do not use the App to submit content you do not have the right to use.

4. AI features

The App offers optional AI features. When you use them, certain text from Your Content may be sent to OpenAI for processing as described in our AI Processing Notice. AI output may be inaccurate or incomplete and must be reviewed before you rely on it — do not rely on AI output for medical, legal, financial, or other critical decisions. You are responsible for not submitting content you do not want processed by a third-party AI service.

AI allowances by plan. Each allowance below is counted per calendar month and resets automatically at the start of the next month. Unused amounts do not carry over.

Free — 1 minute of AI voice processing per month, plus 3 Elan quick captures in total.
Plus — 30 minutes of AI voice processing per month, plus 30 Elan quick captures per month.
Elite — unlimited AI voice processing time for as long as the subscription is active: no limit on the length of a recording, and no monthly ceiling on minutes.

What "unlimited" means for Elite. The time budget is removed entirely — you may record for as long as you like, as often as you like, throughout the subscription period. Two safeguards remain, both aimed at automated or scripted abuse rather than real personal use: a fair-use cap of 5,000 processed recordings per calendar month, and short-term request pacing (per minute, per hour, and per day) that smooths out bursts. Both sit far above realistic personal use (heavy use is a few hundred recordings a day), neither is a limit on a single recording's duration, and reaching either one only pauses AI processing until that window resets — a minute, an hour, a day, or the next calendar month.

Changes to allowances. We may adjust these allowances where necessary for operational, security, or cost reasons. If we reduce an allowance in a way that materially affects a paid plan, we will give notice and the change will take effect no earlier than your next renewal, so a period you have already paid for keeps the allowance you purchased.

5. Subscriptions

Calmendar offers optional auto-renewing subscriptions (Plus and Elite, on a monthly or yearly basis). The price, billing period, and any free trial are shown inside the App before you buy, and payment is charged to your Apple ID at confirmation. A subscription renews automatically for the same period and price unless you cancel at least 24 hours before the current period ends. You can manage or cancel a subscription anytime in your Apple ID settings; deleting the App does not cancel a subscription. Where a free trial is offered, any unused portion is forfeited when you purchase a subscription to that plan.

6. No warranty

The App is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the App will be uninterrupted, error-free, or that it will meet your specific needs.

7. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or goodwill arising out of your use of the App.

8. Third-party services

The App may interact with services you choose, such as iCloud, Google Drive, your device calendar, and OpenAI. Your use of those services is governed by their own terms and privacy policies.

9. Termination

You may stop using the App at any time by deleting it from your device. We may suspend or terminate the App or any feature at any time, including for legal, security, or operational reasons.

10. Changes

We may update the App and these Terms from time to time. The updated version will be indicated by a new effective date above. Continued use of the App after a change means you accept the updated Terms.

11. Governing law

These Terms are governed by the laws of the Kingdom of Saudi Arabia, without regard to its conflict of laws principles, unless a different law is mandatorily applicable to consumers in your jurisdiction.
